To become an Authorised Affiliate of LaBelleDame.com, you must agree to abide by the rules and conditions laid out in this agreement. Please read this agreement carefully and thoroughly before you register to become a LaBelleDame.com affiliate.
By clicking on " I have read the LaBelleDame.com Affiliate Agreement and agree to it's terms." you indicate your understanding and acceptance of this agreement and agree to abide by its terms and conditions. If you do not agree with the terms and conditions of the agreement then you have the option of not registering as a LaBelleDame.com Affiliate.
By agreeing to these terms you are entering into a contract with LaBelleDame.com which may be dissolved at any time by either the associate or LaBelleDame.com .
Our Service
LaBelleDame.com has developed a service which allows our Affiliates to earn money through referring buying customers to our site. LaBelleDame.com will pay our Affiliates 15% of any final sales that are made from following links from the Affiliate's web site or text links. Sales and clearance items are exempt from commission.
LaBelleDame.com will provide our Affiliates with a unique user id and link to enable us to track sales originating from their site for up to 30 days after the customer has followed the Affiliate's link to LaBelleDame.com. This link must not be altered in any way and must be confirmed by LaBelleDame.com before the Affiliate Agreement can be activated.
LaBelleDame.com agrees to supply the promotional images and text to our Affiliates. These materials may not be altered in any way. If materials are altered without express permission, LaBelleDame.com reserves the right to cancel the Affiliate Agreement until the matter has been rectified.
Affiliates will be sent a link to log into an adminstration area for the program to track sales generated from their unique link. This link is not a binding promise of payment. Commissions will be paid only on orders which have received full payment and acceptance of shipment by the customer. Should an item be returned, the commission shall be deducted from the account of the Affiliate. Commissions will be paid no sooner than 44 days from the time an order is made.
LaBelleDame.com will issue payments by PayPal on a bimonthly schedule starting January 1st of each year at a rate of 15% of final sales that have been generated from the Affiliate's unique links. A final sale is defined as a sale for which full payment has been received, shipment has been accepted by customer and the item has not been returned. For this reason sales will not be considered final until 44 days after the order has been placed.
LaBelleDame.com will be responsible for all aspects of order fulfilment including, processing of payments, shipment of orders, processing of all returns and exchanges and all aspects of customer service and relations. Customers who purchase products from LaBelleDame.com through the Affiliate Program will be deemed customers of LaBelleDame.com and will be subject to the same customer service, shipping, and order fulfilment policies as all customers of LaBelleDame.com. LaBelleDame.com reserves the right to change these policies at any point in time. LaBelleDame.com reserves the right to cancel an order at any time to our own discretion.
LaBelleDame.com will be solely responsible for determining pricing and availability of products. Pricing and availability are subject to change without notice. LaBelleDame.com will always be responsible for determining the price paid by the customer.
Affiliates may choose to apply the commissions earned on sales generated by the Affiliate's unique links to a purchase at LaBelleDame.com. The amount will be subtracted from the Affiliate's commission account.
Qualification for the Affiliate Program
In order to qualify for the Affiliate program the applicant must agree to the terms outlined in this contract and signal this agreement by clicking on the link "I have read the LaBelleDame.com Affiliate Agreement and agree to it's terms." located at the bottom of this page. Applicants will be directed to a application form which must be completed in full and submitted to LaBelleDame.com for review.
LaBelleDame.com reserves the right to accept or decline any application to the Affiliate Program. Sites with content that include: promotion of harmful or violent acts towards children, promotion of sexually explicit material, promotion of discrimination based on race, age, sex, sexual orientation and/or nationality, promotion of materials that LaBelleDame.com does not support, will not be granted access to the Affiliate Program.
We encourage only applicants of family friendly sites to apply.
Relationship of Contract Parties
LaBelleDame.com and the Affiliate are independent contractors. Entrance into this contract in no way creates a partnership, joint venture, agency, franchise, sales representative or employment relationship between LaBelleDame.com and its Affiliate Program Members.
Affiliates may not accept any offers or agreements, nor may they make statements or representations on the behalf of LaBelleDame.com
Limitations of Liability
LaBelleDame.com will not be held liable for indirect, special or inconsequential damages, nor will LaBelleDame.com be held liable for any loss of revenue, profits or data which may arise from connection with this agreement and the LaBelleDame.com Affiliate Program, even if we have been advised of the possibility of such damages.
LaBelleDame.com makes no express warranties or representations related to the Affiliate program. LaBelleDame.com makes no promise or representation that the operation of LaBelleDame.com will be without interruption, nor that the site will be error free. We will not be held responsible for errors in LaBelleDame.com nor will we be held responsible for interruption in our site's performance.
LaBelleDame.com makes no promise of minimum earnings to its Affiliate members.
Miscellaneous
This written agreement constitutes the whole of the agreement between LaBelleDame.com and it's Affiliates, and shall be governed by the laws of Canada and the province of Prince Edward Island. You consent that any legal disputes will be argued in the City of Charlottetown, located in the province of Prince Edward Island, Canada. Further you hereby waiver any arguments to personal jurisdiction and inconvenient location.
You may not assign this contract to any other persons.
